We suggest doing the patent search in steps. Doing the Standard Patent Search should be done first since it will cost the least. If an invention like yours is found, InventionMakers may still be able to invent around it, making patentable improvements. If no patent is found, the next step will be to do an Extensive Patent Search to actually prepare for a patent application.
Patents are issued according to their actual design structure, but they
are categorized according to their type of function and to a lesser extent there defining
structure. Thus, by just using key words which describe your invention we can prepare a
list of patents that contain these words. You can then go through the patents and
determine which ones look like they would be close to your invention. However, it is
always better to know exactly what the invention is when doing a patent search. For the
Extensive Patent Search we will need to know exactly what your invention
is. In this case, a NON-DISCLOSURE AGREEMENT will need to be
filled out to protect you and us from misunderstandings. We conduct the mass market evaluation in three steps after a patent search has been done to assure the invention is new. 1) First we conduct an in-house First Evaluation of the invention. This is a review of the products good and bad points for a general marketability of the invention. We normally reject 80% of inventions at this stage, as not being very promising as a commercial product. The reasons for rejection very greatly. 2) If the invention gets a favorable review with our First Evaluation we will recommend that the inventor has a Second Third Party Evaluation for the invention. This is like a second opinion and can save you a lot of money in the long run. The evaluation company we use tends to be much picker than we are on our first evaluation and can detect fatal flaws in a product that others may miss. Our Third party reviewer rejects approximately 75% of those inventions passing InventionMakerstm First review.
3) Finally, if the invention passes these first two evaluations, we often recommend
having a Third Nationally known Evaluation conducted. Only a few
places in the US can conduct these prestigious
evaluations and industry takes notice of any positive outcomes of this
review. This
Once a patentable design has been invented by InventionMakers we can move on to preparing the patent application. Preparing the application can take as long as 3 or 4 months depending on the complexity of the patent, though 1 month is more typical. Below is a chart that shows your costs depending on what percentage ownership in the patent you want.
*United States Patent & Trademark Office (US PTO) Issue Fee are not assessed unless the patent is allowed.It should be noted that government fees change frequently and may be different at the end of the patenting procedure than at the start. The filing Fee, prosecution Fees, and other Misc. fees are paid by InventionMakers and there are no other hidden costs. At the end of the patenting process the inventor will pay the Issue fee. This fee is only paid when the patent office has decided to issue your patent. You will pay this fee directly to the Patent and Trademark Office (PTO). The costs associated with prototyping will very depending on the complexity of the invention. InventionMakers will provide FREE engineering services for its clients to develop a prototype, however, the inventor will be responsible for third party prototype construction costs should InventionMakers not be able to construct the prototype in house. These prototype costs are not compulsory, and it are at the inventors discretion to contract this type of work. Good News! All engineering costs are free for clients under contract.
